OPEN ONLY TO LEGAL RESIDENTS OF THE FIFTY (50) UNITED STATES OR DISTRICT OF COLUMBIA (D.C.) RESIDING WITHIN SIXTY (60) MILES OF NASHVILLE, TN OR WHO ALREADY HAVE CONFIRMED TRAVEL PLANS TO BE IN NASHVILLE, TN OVER JUNE 9, 2024. MUST BE EIGHTEEN (18) YEARS OR OLDER TO ENTER OR WIN.  TRAVEL, ACCOMODATIONS AND ANY OTHER EXPENSES NOT SPECIFICALLY MENTION HEREIN ARE NOT INCLUDED.

ENTRY PERIOD: The Carly Pearce Official Fan Club Early Entry to Carly’s Closet Event Promotion (“Promotion”) begins at 12:00:00 PM Central Time (“CT”) on 05/13/24 and ends at 11:59:59 AM CT on 5/17/24, or when the one hundredth (100^th) spot for early entry (“Entry Spot”) is awarded, whichever one is sooner (“Entry Period”).

 

ELIGIBILITY: The Promotion is open to individuals aged eighteen (18) years or older who at time of entry are legal residents of the fifty (50) United States (including the District of Columbia) who reside within sixty (60) miles of Nashville TN during the Promotion’s Entry Period or who already have confirmed travel plans to be in Nashville, TN on June 9, 2024 (each collectively referred to herein as a “Player” or “Players”). Void where prohibited by law. Employees, directors and officers of the Sponsor, Carly Pearce (“Artist”) and their respective parent companies, affiliated and subsidiary companies, advertising and promotion agencies, web suppliers, consultants, and any other individual or company involved in the creation, production or execution of this Promotion (collectively the “Promotion Entities”), and members of their respective immediate families (spouses, parents, siblings and children and their spouses) and households of each, whether or not related, are not eligible to enter or win. All federal, state, and local laws and regulations apply. Promotion governed by U.S. law.

 

HOW TO PLAY: To qualify and play for a chance to win, each Player should visit https://live.umusic.com/carlys-closet-2024-fan-club-early-entry-promotion  and follow the on-screen instructions to  download, complete and electronically sign the Statement of Eligibility, Liability, Publicity Release (“Release”), enter your first name, last name, email address, zip code, country, upload a copy of your completed and electronically signed Release and click “Submit”.   If you are one of the first Players who have met the eligibility requirements (as detailed above and as determined by the Sponsor or Sponsor’s agent), you will be deemed a “winner” and will be able to claim a prize. If you are not one of the first Players and/or have not met the eligibility requirements, you will not win a prize.

 

Normal Internet access and usage charges imposed by your mobile service or Internet provider will apply. Promotion Entities are not responsible for any lost, interrupted or unavailable network, mail, miscommunications; human or technical errors or difficulties; unauthorized human intervention; and/or traffic congestion. Players must comply with any procedures and instructions imposed by the Sponsor who reserves the right in their sole discretion to suspend or cancel a Player’s participation due to any non-compliance with instructions.

 

PRIZES: One hundred (100) prizes will be awarded.  Each prize winner will receive a spot on the early entry list for the Carly’s Closet event in Nashville, TN on 06/09/24 at a time and location to be determined in Sponsor’s sole discretion and provided upon winner verification (“Event”).   Prizes have no retail value.  Prizes are non-assignable or transferable and cannot be substituted with another prize. Prize does not include any other expenses, all of which are each winner’s sole responsibility. All prize details are at the Sponsor’s sole discretion. Limit: one (1) prize per person. Sponsor is not responsible for any typographical or other error and/or publicity of the Promotion, or in the announcement of any prize or inability to implement the Promotion or award any prize as contemplated herein due to any event beyond its control. No more than the actual number of prizes stated in these Terms and Conditions are available to be claimed and awarded.

 

Except where prohibited by law, participation and acceptance of prize constitute permission for Sponsor and its agents to use each winner’s name, prize won, hometown, for purposes of advertising, promotion and publicity (including online posting) in any and all media now or hereafter known throughout the world in perpetuity, without additional compensation, notification or permission. Furthermore, the Sponsor and/or its agents may film, record and/or take photographs (‘additional content”) before/during/after the Event, and Sponsor shall own all rights to the additional content, and may use the resulting footage, recordings and/or photographs for a range of purposes, including, without limitation, for marketing and promoting the Sponsor and any partner and their respective products and services, with no additional compensation will be provided to any winner or a winner’s guest.

 

A confirmation email prize notification will be sent to potential winners on or around 5/20/24 based on the information provided upon entry.  All potential winners must be eighteen (18) years of age or older and may be required to execute and return a Statement of Eligibility, Liability, Publicity Release (“Release”) as determined by the Sponsor or Sponsor’s agent prior to admission to the Event.  If any prize notification email is returned as undeliverable; or if a potential winner (or their guest) has failed to execute and return the Release, if any, or any required document prior to the Event; or if potential winner is otherwise found to be ineligible; or if the selected potential winner cannot accept or receive the prize for any reason; or if the prize is returned undeliverable, the potential winner will forfeit the prize and an alternate winner may be selected from all non-winning Players in Sponsor’s sole discretion.  Should any winner be found to have made any false statement(s) in the Release or any required document, that winner will be disqualified.

 

SPECIAL CAUTION: COVID-19: Winner and winner’s guest, understand and agree that Event attendance is inherently dangerous due to the COVID-19/Coronavirus pandemic which is a highly contagious and communicable disease; and, to the fullest extent permitted by law, each assumes all risks of illness or injury which may arise directly or indirectly, in whole or in part, from prize related activities. Additionally, winner and winner’s guest understand and agrees that, in response to economic and/or social conditions caused by COVID-19/Coronavirus, Sponsor may be compelled to substitute the prize and/or cancel the Promotion or the Event with little (if any) advanced notice.

 

GENERAL CONDITIONS: By participating, Players affirm they have read, understand and accepted these Terms and Conditions. The Sponsor reserves the right to cancel or modify the Promotion because of fraud, technical failures or any other factor beyond Sponsor’s reasonable control impairs the integrity of the Promotion. In such event, Sponsor reserves the right not to award any prize.  RELEASE OF LIABILITY: By participating in this Promotion, each Player hereby agrees to abide by these Terms & Conditions and the decisions of the Sponsor which are final and binding. Furthermore, each Player agrees to release the Promotion Entities and their respective parent companies, affiliates, subsidiaries, officers, directors, agents, employees and all others associated with the development and execution of this Promotion (collectively, the “Released Parties”) from any and all liability with respect to, or in any way arising from participating in this Promotion and/or awarding/acceptance of a prize if deemed a winner (or winner’s guest), including liability for traveling to/from the Event, personal injury, death, damages (human or property), or monetary loss. Without limiting the generality of the foregoing, the Released Parties are not responsible for interruptions due to acts of God, acts of war, pandemic, natural disasters, weather or acts of terrorism. All issues and questions concerning the construction, validity, interpretation and enforceability of these Terms and Conditions, or the rights and obligations of Players and Sponsor in connection with this Promotion, shall be governed by, and construed in accordance with, the substantive laws of the State of Tennessee without regard to Tennessee choice of law rules.

DATA COLLECTION:  Any data collected in this Promotion will be used in accordance with its privacy policy located at: https://www.bigmachinelabelgroup.com/privacy/ By participating, Players hereby agree to Sponsor’s collection and usage of their personal information (if needed) and acknowledge that they have read and accepted Sponsor’s privacy policy and these Terms and Conditions.
